Terms & Conditions T-Shirt Giveaway Competition

 

  1. The Linda McCartney Foods competition (T-Shirt Giveaway) is open to residents of the United Kingdom (England, Scotland, Wales and Northern Ireland) aged 18 and over except employees and their immediate families of Hain Frozen Foods Limited and members of its group (the “Promoter”), their agents or anyone professionally connected to the T-Shirt Giveaway Competition.
  2. No purchase is necessary in order to enter the competition. Access to the internet and an Instagram account is necessary in order to enter.
  3. By entering this competition, you are deemed to have read and accepted these terms and conditions.  The Promoter reserves the right to disqualify any entries which do not comply with these terms and conditions.
  4. The T-Shirt Giveaway Competition opens at Friday 14th March 2025 at 9am GMT and to enter participants must respond to the promotional post before 12pm GMT Monday 17th March 2025 (“the Competition Period”) for the chance to win.
  5. The sender of each post or comment meeting the requirements of these terms and conditions will be entered into the prize draw. Participants must be members of Instagram and follow the @lindamccartneyfoods account.
  1. To enter, you must:
    1. Like the t-shirt giveaway promotional post.
    2. Comment “🍝” on the t-shirt giveaway promotional post.
    3. Follow the @lindamccartneyfoods Instagram page.
  2. Participants must abide by Instagram’s conditions of use. Any entrant posting or seen to be posting comments via Instagram, or elsewhere, that are considered bullying, spiteful or upsetting to other entrants and followers of @lindamccartneyfoods or are otherwise offensive or inappropriate will be disqualified from the competition. The Promoter reserves the right to alert Instagram to any such behaviour and the participant may have his/her Instagram account frozen pending investigation.
  3. Only one entry per person. Multiple, bulk or third-party entries will not be accepted. Only the first entry made by a participant will be accepted. Entries made on behalf of another person will not be accepted. Offensive or inappropriate comments will not be included within the draw. No responsibility can be accepted for entries that are incomplete, corrupted, delayed, wrongly delivered, or not received for whatever reason.
  4. A person who has previously won a Linda McCartney Foods competition within the past 12 months cannot be the Winner of this competition.
  5. Once the T-Shirt Giveaway Competition closes, 20 participants are randomly selected from all valid and eligible entries submitted during the Competition Period , using an independently verified computer generated system, will be the winners (the "Winners").
  6. The Winners will be contacted via a direct message from @lindamccartneyfoods on Instagram by Friday 21st March 2025 at 12pm GMT and are required to confirm their full name, email address and delivery address by Wednesday 19th March at 11:59am GMT. If the Promoter cannot contact the Winner via the Instagram account provided at entry or if the Winner does not return necessary details within this timeframe, the Promoter reserves the right to conduct a redraw using an independently verified computer generated system.
  7. Each prize will be delivered to the address provided by a winner within 30 days of the end of the Competition Period provided that the Promoter has received the winner’s correct delivery address details and (where deemed necessary by the Promoter) has been able to verify the winner’s identity in accordance with condition.
  8. Winners are responsible for ensuring that complete and correct details are provided to the [Promoter/agent] in order for them to receive their prize.
  9. By entering the T-Shirt Giveaway Competition, you confirm that you are eligible to do so and eligible to claim the prize. The Promoter may require you to provide proof that you are eligible to enter the T-Shirt Giveaway Competition in order to verify this.
  10. There is one prize per winner. There is no cash or alternative to the prize stated in whole or part. The Prize is subject to terms and conditions of use which the winner by entering this competition agrees to. The prize is non-transferrable. The Promoter reserves the right to substitute a prize of equal or greater value in the event of unavailability of the intended prizes.
  11. The Winners agree, if requested, to participate in related publicity accompanying or resulting from the T-Shirt Giveaway Competition without further recompense. The Winners further agree that your competition entry (“Submission”) all materials produced pursuant to the T-Shirt Giveaway Competition and will remain the property of the Promoter. To the extent that copyright arises in your Submission, you will own such copyright in your Submission but agree to grant and license the Promoter (without compensation, restriction on use, attribution or liability) a non-exclusive, royalty-free, perpetual, worldwide, irrevocable, sub-licensable right to re-use, copy, reproduce, modify, adapt, alter, combine with other materials, edit, incorporate, broadcast, telecast, exhibit, publish, re-publish, display, portray and/or otherwise use your Submission (and any parts of your Submission) in any worldwide media. You agree not to assert any moral rights in relation to such use and also agree that the Promoter will own all rights in any materials, photographs, videos and other works which use your Submission (in whole or part).
  12. In the event that circumstances beyond the reasonable control of the Promoter affect, or could affect, the proper operation of this T-Shirt Giveaway Competition, the Promoter reserves the right to cancel or amend the T-Shirt Giveaway Competition or these terms and conditions at any time but will make every effort to avoid causing undue disappointment to participants where such action is deemed necessary.
  13. The Promoter shall not be liable for any failure of any third party to fulfil its contractual obligations although the Promoter shall try to minimise the effect of such failures.
  14. By entering the competition, you:
    1. agree that any personal information provided by you with the competition entry may be held and used only by the Promoter or its agents and suppliers to administer the competition and for any other purposes to which you have expressly consented;
    2. acknowledge that such personal data may be transferred by the Promoter to, and/or stored in, a destination outside the European Economic Area for administrative purposes, including to the United States of America, where data protection regulations may not offer the same protection as those applicable in the European Economic Area, provided that the Promoter uses reasonable endeavours to keep such data adequately protected.

  16. This T-Shirt Giveaway Competition is in no way sponsored, endorsed or administered by, or associated with Instagram. Instagram shall not be liable for any loss, damage or liability caused by matters relating to this T-Shirt Giveaway Competition. The information you provide will only be used for the purpose of facilitating the T-Shirt Giveaway Competition unless you have agreed to its use for any other purpose. By entering the T-Shirt Giveaway Competition, all entrants agree to give Instagram a complete release from any and all legal liability in connection with the T-Shirt Giveaway Competition.
  17. The Promoter reserves all rights relating to their social media pages and accounts, including but not limited to: (i) adding, removing, or modifying any content posted on the accounts, (ii) blocking users; and (iii) discontinuing the accounts at any time.
  18. All entries will be subject to Instagram’s terms of use which can be found at http://instagram.com/legal/terms/.
  19. By entering the competition, you are deemed to have read, understood and accepted the Promoter’s privacy policy, a copy of which can be found at https://www.haindaniels.com/privacy-policy/.
  20. Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate participants or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees.
  21. Nothing in these terms and conditions shall operate to limit or exclude its liability for death or personal injury caused by its negligence or for fraud (including, but not limited to, fraudulent misrepresentation) or for that which cannot lawfully be excluded.
  22. Nothing in these terms and conditions shall affect the winner’s statutory rights.
  23. If any provision of these terms and conditions is held by a competent authority to be invalid or unenforceable, the remaining provisions of these terms and conditions will not be affected and will remain valid.
  24. Nothing in these terms and conditions shall confer any rights on any person under the Contracts (Rights of Third Parties) Act 1999, other than the release of liability given in favour of Instagram which may be enforced by Instagram.
  25. These terms and conditions are governed by English Law and any dispute arising under these terms and conditions (whether such disputes or issues are contractual or non-contractual in nature, such as claims in tort, for breach of statute or regulation or otherwise) shall be subject to the exclusive jurisdiction of the English courts.
